1. ACCEPTANCE OF TERMS

Welcome to Centre de développement en Karate Zanshin, also referred to as "Karate Zanshin," "we," "us," "our," or "the Dojo." These Terms of Service ("Terms") govern your access to and use of our martial arts training services, website, and facilities located at 4230 Boul. Saint-Jean, suite #205, Dollard-des-Ormeaux, H9H 3X4, Quebec, Canada.

By registering for classes, attending sessions, using our website, or accessing our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

For participants under the age of 18, a parent or legal guardian must read, understand, and agree to these Terms on behalf of the minor participant.

2. SERVICES DESCRIPTION

Karate Zanshin provides martial arts instruction, training programs, and related services including but not limited to:

• Group karate classes for various skill levels (beginner, intermediate, advanced)
• Kids and youth programs (ages 5-17)
• Adult training programs
• Private lessons
• Belt promotion and testing
• Competition preparation and coaching
• Special events, workshops, and seminars

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to members.

3. REGISTRATION AND MEMBERSHIP

3.1 Eligibility

To participate in our programs, you must:

• Be at least 5 years of age (or meet the minimum age requirement for specific programs); for participants under the age of 18, a parent or legal guardian must complete registration, provide consent, and agree to these Terms on behalf of the minor
• Complete all required registration forms and waivers
• Provide accurate and complete information during registration
• Maintain current contact information with the Dojo
• Comply with all health and safety requirements

3.2 Registration Process

Registration may be completed:

• Online through our website
• In person at the Dojo
• By phone or email

All registrations are subject to approval by Karate Zanshin. We reserve the right to refuse service to anyone at our discretion.

3.3 Membership Types

We offer various membership options including monthly memberships, class packages, and drop-in rates. Specific terms, pricing, and benefits for each membership type are detailed in our pricing information and may be updated from time to time.

4. PAYMENT TERMS

4.1 Fees and Payment

All fees are due in advance according to your selected membership plan. Payment methods accepted include cash and e-transfer. Prices are in Canadian Dollars (CAD) unless otherwise stated.

4.2 Automatic Renewal

Monthly memberships automatically renew unless cancelled in accordance with our cancellation policy. Members are responsible for submitting payment (cash or e-transfer) by the renewal date to maintain active membership status.

4.3 Late Payments

If payment is not received by the due date:

• We may suspend your access to classes and facilities
• A late fee may be applied
• We reserve the right to cancel your membership

4.4 Price Changes

We reserve the right to modify our pricing at any time. Existing members will be given at least 30 days' notice of any price increases affecting their membership.

5. CANCELLATION AND REFUND POLICY

5.1 Membership Cancellation

You may cancel your membership at any time by providing written notice to Karate Zanshin. Cancellation requests must be submitted at least 7 days before your next billing cycle to avoid charges for the upcoming period.

• Written notice delivered to our address

5.2 Refund Policy

All refund requests must be submitted in writing and will be processed within 14 business days. Refunds will be issued to the original payment method.

5.3 Medical Cancellations

In cases of documented medical conditions preventing participation, we may offer membership freezes or pro-rated refunds at our discretion. Medical documentation may be required.

6. CODE OF CONDUCT

6.1 Student Behavior

All students and participants are expected to:

• Show respect to instructors, fellow students, and Dojo property
• Follow all safety rules and instructions
• Maintain appropriate hygiene and cleanliness
• Wear appropriate attire as specified by the Dojo
• Arrive on time for classes
• Notify instructors of any injuries or health concerns
• Refrain from disruptive, abusive, or inappropriate behavior
• Not use martial arts techniques outside the Dojo inappropriately

6.2 Prohibited Conduct

The following behaviors are strictly prohibited and may result in immediate suspension or termination of membership:

• Physical violence, threats, or intimidation
• Harassment, discrimination, or bullying of any kind
• Use of drugs or alcohol on Dojo premises
• Theft or damage to Dojo property or other students' belongings
• Unauthorized photography or recording without consent
• Disruptive behavior that interferes with classes or other students
• Violation of safety protocols

6.3 Disciplinary Actions

Violations of the Code of Conduct may result in:

• Verbal warning
• Written warning
• Temporary suspension
• Permanent termination of membership without refund

We reserve the right to take immediate action, including removal from premises, for serious violations.

7. HEALTH, SAFETY, AND LIABILITY

7.1 Assumption of Risk

You understand that:

• Martial arts training is a physical activity with inherent risks
• Injuries may occur despite proper instruction and safety measures
• You are responsible for assessing your own physical condition and limitations
• You should consult with a physician before beginning any exercise program

7.2 Health Requirements

You must:

• Disclose any medical conditions, injuries, or physical limitations that may affect your participation
• Inform instructors immediately of any injuries or health concerns
• Follow medical advice regarding participation restrictions
• Not participate while under the influence of drugs or alcohol

7.3 Waiver and Release of Liability

By participating in Karate Zanshin programs, you agree to:

• Release, waive, and discharge Karate Zanshin, its owners, instructors, employees, and agents from any and all liability for injuries, damages, or losses
• Hold harmless Karate Zanshin from any claims, demands, or causes of action arising from your participation
• Assume full responsibility for any injuries or damages you may sustain
• Indemnify Karate Zanshin against any claims brought by third parties related to your participation

This waiver applies to all activities, including classes, events, competitions, and use of facilities.

7.4 Insurance

Karate Zanshin maintains general liability insurance. However, we strongly recommend that participants maintain their own personal health and accident insurance coverage.

8. INTELLECTUAL PROPERTY

8.1 Dojo Materials

All curriculum, training materials, techniques, logos, trademarks, and content provided by Karate Zanshin are protected by intellectual property laws. You may not:

• Reproduce, distribute, or share training materials without authorization
• Use Karate Zanshin's name, logo, or trademarks without permission
• Record classes or training sessions without explicit consent
• Create derivative works based on our curriculum

8.2 Photography and Media

Karate Zanshin may photograph or record classes and events for promotional purposes. By participating, you consent to the use of your image and likeness in promotional materials, unless you provide written notice to the contrary.

8.3 Official Media Partnership

8.4 Student Photography and Recording

You may not photograph or record other students, instructors, or dojo activities without:

• Explicit written consent from Karate Zanshin
• Consent from all individuals being photographed or recorded
• Compliance with our media policy guidelines

Unauthorized photography or recording may result in disciplinary action, including suspension or termination of membership.

8.5 Media Usage Rights

All media captured by Karate Zanshin or StationTape Media:

• Remains the property of Karate Zanshin and/or StationTape Media
• May be used by Karate Zanshin for promotional, educational, and marketing purposes
• May be shared on Karate Zanshin's website, social media platforms, and in print materials
• May be used by StationTape Media for their professional showcase, portfolio, website, social media, and promotional materials to demonstrate their photography and videography services
• Will not be sold to third parties for commercial use without additional consent

By participating in Karate Zanshin programs, you acknowledge that StationTape Media may display images and videos featuring you or your child in their professional portfolio and marketing materials as examples of their work. This is a standard practice in professional photography and videography services.

9. PRIVACY POLICY

Your privacy is important to us. We collect and use personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

• We use reasonable security measures to protect your information

10. CLASS SCHEDULE AND ATTENDANCE

10.1 Schedule Changes

We reserve the right to:

• Modify class schedules with reasonable notice
• Cancel classes due to weather, emergencies, or other circumstances
• Substitute instructors when necessary
• Combine or split classes based on attendance

10.2 Make-Up Classes

Make-up classes may be available for missed sessions, subject to:

• Advance notice of absence (when possible)
• Availability of space in other classes
• Make-up classes must be used within the same billing period

Make-up classes are not guaranteed and are subject to availability.

10.3 Class Capacity

Classes have limited capacity. We reserve the right to limit enrollment to ensure quality instruction and safety. Priority may be given to members with active memberships.

11. BELT PROMOTIONS AND TESTING

Belt promotions are based on:

• Technical proficiency as assessed by instructors
• Regular attendance and participation
• Demonstration of proper attitude and respect
• Completion of required training hours
• Successful completion of belt testing (when applicable)

Belt testing fees are separate from membership fees and are non-refundable once testing has commenced. Promotion decisions are made at the sole discretion of Karate Zanshin instructors.

12. FACILITY USE

12.1 Access

Facility access is limited to:

• Active members during scheduled class times
• Authorized personnel
• Guests with prior approval (subject to guest policies)

12.2 Equipment and Property

You are responsible for:

• Proper use and care of Dojo equipment
• Reporting any damaged or unsafe equipment
• Not removing equipment from the premises
• Respecting Dojo property and facilities

Damage to Dojo property caused by negligence or misuse may result in charges for repair or replacement.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated to members through:

• Email notification
• Posting on our website
• Notice at the Dojo

Continued use of our services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your membership.

14. TERMINATION

14.1 Termination by Member

You may terminate your membership at any time in accordance with our cancellation policy (Section 5).

14.2 Termination by Karate Zanshin

Karate Zanshin may terminate or suspend your membership immediately, without refund, for:

• Violation of these Terms or Code of Conduct
• Non-payment of fees
• Behavior that threatens the safety of others
• Any other reason we deem necessary to protect the Dojo community

15. DISPUTE RESOLUTION

Any disputes arising from these Terms or your use of our services shall be resolved through:

1. Good Faith Discussion: Parties agree to attempt to resolve disputes through direct communication
2. Mediation: If direct discussion fails, disputes may be submitted to mediation in Quebec, Canada
3. Governing Law: These Terms are governed by the laws of Quebec, Canada, and applicable federal laws
4. Jurisdiction: Any legal proceedings shall be conducted in the courts of Quebec, Canada

16. FORCE MAJEURE

Karate Zanshin shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• Pandemics or public health emergencies
• Government actions or regulations
• War, terrorism, or civil unrest
• Labor strikes
• Utility failures

In such circumstances, we may suspend services and will work with members to find reasonable accommodations when possible.

17. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. ENTIRE AGREEMENT

These Terms, together with any signed waivers, registration forms, and our Privacy Policy, constitute the entire agreement between you and Karate Zanshin regarding your use of our services, superseding all prior agreements and understandings.
